Contracting parties: Laubenthal GbR, Kelbergerstraße 13, 56766 Ulmen, Germany, represented by Dirk Laubenthal & Barbara Laubenthal, email: support@maedchenundmotoren.de. As of September 2026.
Scope: Germany, the European Union and worldwide deliveries · B2C and B2B.
1. Scope and contracting parties
1.1 These General Terms and Conditions apply to all orders placed between the customer and Laubenthal GbR, Kelbergerstraße 13, 56766 Ulmen, Germany, represented by the shareholders Dirk Laubenthal & Barbara Laubenthal, email: support@maedchenundmotoren.de, via the Mädchen & Motoren online shop.
1.2 These General Terms and Conditions apply to both consumers and entrepreneurs. Consumers and entrepreneurs are defined in accordance with Sections 13 and 14 of the German Civil Code (BGB).
1.3 Where certain provisions apply exclusively to consumers or entrepreneurs, this will be expressly indicated.
1.4 Any deviating terms and conditions provided by an entrepreneur shall not form part of the contract unless their validity has been expressly agreed to in writing.
2. Offer and conclusion of contract
2.1 The presentation of products in the online shop does not generally constitute a binding contractual offer, but rather an invitation to the customer to place an order.
2.2 By clicking the final order button, the customer makes a binding offer to purchase the goods contained in the shopping cart. An offer to contract, once made, is generally binding.
2.3 An order or receipt confirmation sent automatically immediately after the order initially only confirms receipt of the order and, unless expressly stated otherwise therein, does not constitute acceptance of the contractual offer.
2.4 The contract of purchase is concluded as soon as Laubenthal GbR accepts the customer's offer within a reasonable acceptance period by an express order or shipping confirmation, by shipping the goods, or by any other clear declaration of acceptance.
2.5 If, due to the chosen payment method, payment authorization or debit has already taken place prior to acceptance of the contract and the order is subsequently not accepted, any amount already collected will be refunded without delay.
2.6 We are entitled, in particular, to reject an order prior to acceptance of the contract if an item is not available, there is an obvious price or system error, payment problems arise, or other objective reasons prevent proper performance of the contract.
3. Prices and shipping costs
3.1 All prices stated to consumers include the applicable statutory value added tax.
3.2 Standard shipping within Germany costs €5.99. Standard shipping within Germany is free for an order value of €49 or more after discounts. Shipping costs for other delivery countries are listed in our shipping information. Applicable shipping costs are displayed before the order is placed.
3.3 For deliveries outside the European Union, customs duties, import value added taxes, or other public levies of the destination country may also apply.
4. Payment terms
4.1 The payment methods displayed during the respective ordering process are available.
4.2 Unless otherwise stated for the respective payment method, the purchase price is due immediately upon conclusion of the contract.
5. Delivery and delivery times
5.1 Delivery will be made to the delivery address provided by the customer during the ordering process.
5.2 Unless a different delivery time is stated for the respective product, the following delivery times generally apply: Germany approx. 2–5 business days, European Union approx. 5–10 business days, other international deliveries approx. 7–21 business days.
6. Retention of title
The delivered goods remain the property of Laubenthal GbR until full payment of the respective purchase price has been received.
7. Customized and personalized products
For goods that are not pre-made and whose production depends significantly on an individual selection or specification by the consumer (e.g. names, custom text, custom designs), there is no statutory right of withdrawal pursuant to Section 312g(2) No. 1 of the German Civil Code (BGB).
8. Right of withdrawal for consumers
Consumers generally have a statutory right of withdrawal for distance contracts. Details are set out in the shop's separate withdrawal policy.
9. Underwear and hygiene products
For sealed goods that are not suitable for return for reasons of health protection or hygiene, the right of withdrawal expires if the seal has been removed or damaged after delivery (Section 312g(2) No. 3 of the German Civil Code (BGB)). This may apply in particular to hygienically sealed panties, thongs and other underwear.
10. Rights regarding defects
Consumers are entitled to statutory rights regarding defects. The standard limitation period is two years from delivery. For entrepreneurs, the limitation period for newly manufactured goods is one year from delivery.
11. Liability
We are liable without limitation for intent and gross negligence, for culpable injury to life, body or health, under the Product Liability Act, and for any express warranty undertaken. In cases of ordinary negligence, we are only liable for breaches of essential contractual obligations, limited to foreseeable, contract-typical damages.
12. Choice of law and jurisdiction
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the customer is a trader or a public law entity, the registered office of Laubenthal GbR shall be agreed as the place of jurisdiction.
13. Consumer dispute resolution
Laubenthal GbR is neither willing nor obliged to participate in dispute resolution proceedings before a consumer dispute resolution body.
14. Final provisions
If any provision of these General Terms and Conditions is invalid, the remaining provisions shall remain in effect.
